The commissioner of the Central Goods and Services Tax (CGST) Mumbai zone on Wednesday arrested a senior official of a Chinese smartphone manufacturer in the Thane district of Maharashtra for allegedly fraudulently obtaining a tax credit (ITC) of Rs 19 crore through fake invoices. Oppo Mobiles India Finance and Accounts Manager Mahendra Kumar Rawat was arrested in Bhiwandi City and later taken to the local court, who held him until April 3, CGST Commissioner Bhiwandi said in a statement.
On the basis of material evidence collected during the investigation, he was arrested under Article 69 of the CGT Law of 2017 for violating Article 132 of the same law.
The statement said that an investigation by the anti-evasion unit of CGST Bhiwandi Commissionerate found that Oppo Maharashtra was involved in the use of counterfeit ITCs without receiving any goods.
“The supplier of Oppo Mobiles India Pvt ltd, M/S Gain Hero India Private Limited, has been declared defunct at its principal place of business. In this regard, 16 electronic invoices for the specified transaction were checked and found. “Fake”. In addition, statements from carriers and the owner of the vehicle were recorded, from which it turned out that there were no deliveries of goods to Oppo Maharashtra,” the report says.
Rawat, Authorized Signatory and Financial and Account Manager of Oppo Mobiles India, is the main person who played a key role in the said fraudulent ITC of Rs 19,27,54,093 on accounts of Rs 107,08,56,072. issued by Gain Hero India without receiving the goods, he added.
The defendant admitted in his statement that the generated electronic waybills are fake, the CGST commissioner said.
The case is part of a special campaign organized by CGST Mumbai Zone against tax fraudsters and tax evaders. Commissioner of CGST Bhiwandi has himself arrested 24 people in the past 18 months, said Sumit Kumar, commissioner of Central GST Bhiwandi.
